This agreement applies to every rental of durable medical equipment ("Equipment") from Brothers DME, LLC ("Brothers DME", "we", "our").
1. The equipment stays ours.
Equipment rented under this agreement is owned by Brothers DME. Each unit is labeled with a Brothers DME identification sticker that must remain attached. You ("the Renter") have a temporary right to use the Equipment while your rental is active and in good standing.
2. Monthly rental.
You'll be charged the monthly rate shown at checkout on the day your first month begins, and then every 30 days thereafter via the payment method on file, until you return the Equipment or we retrieve it. Prices are flat — no insurance, no hidden fees. Update your card any time at your patient dashboard.
3. Delivery & urgency.
You'll select one of three delivery tiers at checkout:
- Urgent — target delivery within 2 hours; includes a flat $49 one-time surcharge on your first invoice.
- Same-day — delivery within the current calendar day at the standard rate.
- Scheduled — delivery on a future date you choose.
Actual ETA depends on driver availability and your location. We're honest about our realistic ETA at checkout — no bait-and-switch.
4. At-door agreement.
At delivery, you and the Brothers DME driver will each sign this agreement on the driver's device. A copy of the signed agreement is emailed to you and stored in your patient dashboard for the life of the rental.
5. Payment failure & 3-day grace.
If your monthly payment fails, we'll notify you and retry automatically. You have a 3-day grace periodto update your payment method. If payment isn't resolved within 3 days, we'll dispatch a driver to retrieve the Equipment. You authorize this retrieval by accepting this agreement.
6. Retrieval ("repossession").
If we retrieve Equipment due to non-payment, damage to the unit, or termination of this agreement for any reason, you agree to:
- Grant the Brothers DME driver reasonable access to the location where the Equipment is installed.
- Not interfere with the retrieval.
- Accept that retrieval does not cancel outstanding amounts due.
7. Care of the equipment.
Use the Equipment as intended. Keep it reasonably clean. Report damage or malfunction immediately — we'll swap it out at no charge for mechanical failure or normal wear. You're responsible for damage beyond normal wear.
8. Adding equipment.
Additional Equipment rented while you have an active rental will be added to your monthly subscription cumulatively. Call dispatch to add to a live rental — we'll prorate the billing.
9. Ending the rental.
Request pickup any time from your patient dashboard. A driver will schedule retrieval within the hour. Cancel your subscription separately in Manage billing so charges stop at the end of your current cycle.
